Thank you for supporting globie (herein referred to as “globie,” “we,” or “us”) Our fans are what make our community great and while we welcome user-created art inspired by our content, we have created the following guidelines to ensure that our community remains a safe and enjoyable place for everyone. We appreciate your cooperation in following these guidelines and in helping us build and sustain a positive and thriving community around globie. If you create or use any User-Created Content or Video Reproductions (as defined below), you will be deemed to consent to all the terms and conditions set forth in these guidelines. You are not allowed to create or use User-Created Content or Video Reproductions if you do not agree to these guidelines. Please comply with these guidelines when you create and use User-Created Content or Video Reproductions.

These guidelines are subject to change without notice. Please refer back to this page for all updated terms. Please note that we are not liable for any damages incurred to globie users as a result of change to these guidelines.

means all works created, published and/or owned by globie including, without limitation, official characters, models, images and illustrations, videos (including clip videos), live contents, scenarios, music and sound recordings.

means original works created by globie users inspired by or incorporating elements of globie Content. To be considered User-Created Content, the works must substantially transform, modify or adapt globie Content, and any work without any original creativity by globie users does not fall under User-Created Content.

means any User-Created Content which incorporates any audio or video footage created, published and/or owned by globie including, without limitation, live broadcasts by any globie performers.

means any activity conducted by individuals or unincorporated organizations whereby User-Created Content is freely distributed via physical or digital means without the purpose of making a profit. To be considered a Fan Activity, (i) the activity must be conducted without the purpose of making a profit, (ii) any User-Created Content must be distributed for free or, if distributed for value, in exchange for small amounts, as further defined below, such as the actual price of raw materials or other actually paid costs incurred in production of the User-Created Content and (iii) any User-Created Content must be created and used solely for the Grobie user’s personal interest and must not be used for advertisement for any goods or services. If any of the above requirements is not satisfied, Grobie users need to obtain prior permission of globie through a separate application.

“Small amounts” mentioned in (ii) above is satisfied if it meets the following requirements depending on the situation.

• A. When exhibiting at an event and selling fan magazines and fan goods.
  The total number of products to be sold in one event must not exceed 500 units and the estimated sales amount (the number of products produced x sales price (excluding tax)) in one event must not exceed GBP 2,500. “One event” mentioned in the foregoing means: (a) an in-person event that is held during a specified period; and (b) a sale of the remaining inventory of the forementioned in-person event at a fan EC website or fan shop. The total units and estimated sales amount of (a) and (b) must satisfy the above requirements.
  
  
• B. When selling fan magazines and fan goods without exhibiting at an event.
  The total number of products to be sold during a year must not exceed 250 units and the estimated sales amount (number of products produced x sales price (excluding tax)) during a year must not exceed GBP 1,250. In the case where the estimated number of sales cannot be specified in advance and the number of sales during a year is likely to exceed 250 units, globie users must either discontinue the sale or obtain an approval from globie through a separate application.
  
  
• C. For activities that do not involve publications, etc. and generate a small amount of revenue.
  The estimated sales amount must not exceed GBP 1,250 in total sales during a year.
  This category includes: (a) activities in which a request to write is made through the service and compensation is paid; and (b) distribution of works in a closed community through paid subscription services in compliance with these guidelines. If it is difficult to calculate the estimated sales amount (such as in a case of paid subscription service), please make sure to submit an application for an approval of globie in advance.
  
  

If globie users wish to produce works in excess of the stipulated conditions in each activity listed in A, B and C above, our decision will be made based on the globie user’s advance application and our assessment. This decision is made based comprehensively on, amongst others, the production quantity of the work, the sales price of the work, the nature of the work, the usual content of the activity, etc., and globie may give globie users conditional permission (e.g., limitation on the number of sale, expected sales amount, etc.) or request globie users to discontinue the sale. For advance application, please fill in and submit the designated form. Please note that it may take up to five business days for a response

Any activity that is conducted for the globie user’s personal interest and does not generate any revenue is permissible as a non-profit fan activity. The typical examples for such non-profit fan activity include:

• - Cosplay activity that does not involve sale of photos, etc. for a fee.
• - Printing on car bodies, etc. that does not involve sale of photos, etc. for a fee. However, use of globie Content itself without creative and substantial transformation, modification or adaptation is not permissible.

However, globie asks globie users to contact us in advance using the designated form for the following activity, even if it does not generate any income:

• - Supporting advertisements using Use-Created Content in non-profit fan activity, such as at train stations and on street screens, etc.

globie permits the creation and distribution of User-Created Content including, but not limited to, illustrations, fan magazines, manga, novels and cosplay costumes.

User-Created Content may be distributed only within the scope of Fan Activities. globie permits the distribution of User-Created Content within the scope of this use without expectation or requirement of any licensing or royalty fee.

Any User-Created Content must include clear and visible attribution to globie and identification of the User-Created Content as user-created and not official globie Content.

Any User-Created Content must not include images of people featured or identified individuals who are under the age of 18, and if featured or identified individuals are under the age of 18, globie users must either: (a) be the parent or legal guardian of such featured or identified individuals; or (b) have obtained express consent from a parent or legal guardian of such featured or identified individuals to their appearance in the User-Created Content.

globie permits the creation and distribution of Video Reproductions only within the scope of Fan Activities. No Video Reproductions may be created or distributed for use in advertising or promoting any content, products or services outside of globie Content.

Any Video Reproductions must include clear and visible attribution to globie in the video. Any posts of Video Reproductions must include the URL of the original globie video or broadcast transmission in the summary section or description.

Any Video Reproductions must not include images of people featured or identified individuals who are under the age of 18, and if featured or identified individuals are under the age of 18, globie users must either: (a) be the parent or legal guardian of such featured or identified individuals; or (b) have obtained express consent from a parent or legal guardian of such featured or identified individuals to their appearance in the Video Reproductions.

Please refrain from posting any Video Reproductions before the original globie broadcast transmission or distribution ends and the archive of the original globie video is made public.

When creating or distributing User-Created Content, the following are strictly prohibited by globie. If a globie user’s activity falls under any of the following determined by globie in our discretion, globie has the right to request the globie user to discontinue the activity and to pay royalties even if the globie user’s activity is within the scope of the permission set forth above. If a globie user’s activity falls under any of the following determined by globie in our discretion, and as a result of this, we suffer any loss and/or damage, the globie user will be liable to us and hereby agree to indemnify us for any such loss or damage. We also reserve the right to pass on any User-Created Content and Video Reproductions that gives us concern to the relevant authorities.

1. Any commercial use of User-Created Content with or without compensation. Any sale of User-Created Content which exceeds the number of unit or sales amount specified above (A to C in the definition of “Fan Activities") will be considered “commercial use.”
2. Any direct use of globie Content without substantial transformation, modification or adaptation. These guidelines do not permit use of the globie Content either as-is or in a form other than mere modification without creativity.
3. Any use of globie Content which damages, detracts or dilutes the image or reputation of globie or globie Content.
4. Any use of globie Content which violates any applicable laws, regulations or public policy, or which exceeds socially acceptable limits of morality.
5. Any use of globie Content which infringes or may infringe on the intellectual property rights or any other rights of globie, any of its affiliates, or any third parties.
6. Any use of globie Content in User-Created Content which depicts graphic violence, illegal drug use, religious ritual, agitation, historical persecution with a political, religious or war-related background, or perpetrator of bullying or crime.
7. The production or distribution of User-Created Content which is or can be mischaracterized or misrepresented as to suggest being official globie Content.
8. Any use of globie Content which may lead to discrimination based on race, creed, religion, gender, social status, etc.
9. Any use of globie Content in User-Created Content which promotes a specific creed, religion, or political party or action.
10. Any reproduction or distribution of globie Content without permission.
11. Any use of globie Content which is deemed to be beyond the scope of User-Created Content as described in these guidelines.
12. Any use of globie Content by a globie user who did not remedy non-compliance with any of these guidelines after receiving a warning for such non-compliance from globie.
13. Any use of globie Content which globie determines is inappropriate based on reasonable ground.

By publishing or circulating User-Created Content or Video Reproductions, globie users irrevocably consent to a non-exclusive, perpetual, irrevocable, transferrable, royalty-free license to repost or use for any other purposes all or part of such User-Created Content or Video Reproductions by globie, including, without limitation, distribution on the Internet for globie project, posting on social media, use as a thumbnail image on video contents and playing videos in performer’s videos related to globie, without any compensation. If globie wishes to make official distribution or merchandising, globie will contact globie users on an individual basis.

globie encourages globie users to use the social media tags or hashtags associated with globie and globie creators when posting or distributing any User-Created Content. Please note, however, that even User-Created Content not tagged with social media tags or hashtags may still be used by globie pursuant to the preceding paragraph.

Please refrain from plagiarizing any plots or stories used in any globie Content into any manga, novel, screenplay, stage play, or dramatic reading. These guidelines also apply to any plots and stories of globie Content that are translated into any other languages by globie. Spoilers of such plot or stories must be done at a closed forum or between friends.

globie may not respond to inquiries regarding User-Created Content deemed by globie to comply with these guidelines.

These guidelines apply only to individual persons or unincorporated organizations (including doujinshi, circles, or other fan groups). These guidelines do not apply to commercial entities seeking to reproduce or distribute globie Content. These guidelines do not apply to any cases in which an activity is conducted by company (including cases in which an activity is conducted substantively by company, such as the case where a company bears the production costs, etc., even if the activity is under the name of an individual person). If you are a company interested in reproducing or distributing globie Content or any secondary works which incorporate globie Content, please contact us through globie contact form.

Notwithstanding the any information contained herein, globie reserves the right to request individual users discontinue use of any globie Content as it deems it necessary. globie is not responsible for any damages incurred to globie users due to the discontinuation of the use.

globie is not responsible for any dispute and trouble over creation and use of the secondary work of globie Content. Please enjoy creation and use of User-Created Content and Video Reproductions at your own risk and responsibility.

All matters related to these guidelines shall be governed by the laws of England, and the courts located in London, the U.K. shall have exclusive jurisdiction as the court of first instance.
